PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING DOCUMENT. BY SIGNING BELOW, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
I, the undersigned, am the parent or legal guardian of the child named in this form. In consideration of my child being permitted to participate in Baba B-Ball youth basketball training sessions, I freely and voluntarily agree to the following:
1. INSTRUCTOR DISCLOSURE: I understand and fully acknowledge that Babasemilore "Semi" Opadele (age 17) and Babadarasimi "Dara" Opadele (age 13) are minor-aged, teenage basketball players providing informal youth basketball instruction. THEY ARE NOT certified coaches, licensed athletic trainers, medical professionals, CPR/first-aid certified, or childcare providers. They are experienced competitive basketball players who train at elite-level programs. I accept this arrangement knowingly and voluntarily.
2. ASSUMPTION OF RISK: I understand that basketball training and related physical activities involve INHERENT RISKS of physical injury, including but not limited to: sprains, strains, fractures, dislocations, concussions, contusions, lacerations, heat-related illness, cardiac events, and other serious bodily injury, including the potential for permanent disability or death. I understand these risks cannot be fully eliminated regardless of the care taken. On behalf of myself and my child, I VOLUNTARILY ASSUME ALL RISKS, both known and unknown, associated with my child's participation, even if arising from the negligence of the Released Parties.
3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS: I hereby release, waive, discharge, and covenant not to sue Babasemilore Opadele, Babadarasimi Opadele, the Opadele family (including all parents, guardians, siblings, and household members), Baba B-Ball, the Baba B-Ball coaching staff and affiliates, Christian Herbie Clarke (website designer), Shopify, Inc. (payment processing platform), any venue, church (including the Church of Jesus Christ of Latter-day Saints), facility owner or operator, organization, and any of their respective agents, representatives, volunteers, successors, and assigns (collectively, the "Released Parties") from ANY AND ALL liability, claims, demands, actions, causes of action, damages, losses, or expenses (including attorney fees) arising out of or related to any injury, illness, death, or property damage sustained by my child during, or as a result of, participation in Baba B-Ball sessions, WHETHER CAUSED BY THE NEGLIGENCE of the Released Parties or otherwise.
4. INDEMNIFICATION: I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, suits, losses, damages, costs, and expenses (including reasonable attorney fees) brought by or on behalf of my child, any family member, or any third party, arising out of my child's participation in Baba B-Ball sessions.
5. VENUE AND FACILITY DISCLAIMER: I understand that Baba B-Ball sessions are held at third-party facilities in Hyde Park, Chicago, Illinois (parks, recreation centers, gyms, outdoor courts, or other locations) that are NOT owned, operated, leased, or controlled by the Released Parties. Session locations may change at any time. THE FACILITY OWNERS AND OPERATORS ACCEPT NO LIABILITY for any injury, loss, or damage arising from Baba B-Ball sessions conducted on their premises. Neither the Released Parties nor any facility owner or operator is responsible for the condition, maintenance, or safety of any venue. I accept all risks associated with the facilities used, including but not limited to: uneven surfaces, wet conditions, equipment defects, inadequate lighting, proximity to traffic, and other environmental hazards.
6. PARENTAL SUPERVISION REQUIREMENT: I understand and agree that a parent or legal guardian MUST remain physically present and on-site during ALL training sessions. The instructors are minors themselves and are NOT responsible for supervising, transporting, or caring for children before, during breaks, or after scheduled session times. I acknowledge that I retain full parental responsibility at all times.
7. MEDICAL REPRESENTATION AND AUTHORIZATION: I represent and warrant that my child is physically fit and healthy enough to participate in basketball training activities. I have disclosed any and all known medical conditions, allergies, disabilities, or limitations that may affect my child's ability to safely participate. In the event of a medical emergency, I authorize the instructors to call 911 or emergency medical services on my child's behalf. I understand that the instructors are NOT medical professionals and will not administer any medical treatment. I accept full financial responsibility for any medical care provided to my child.
8. NO INSURANCE: I understand that Baba B-Ball does NOT carry commercial general liability insurance, sports accident insurance, or any other form of insurance coverage for participants. I am solely responsible for maintaining adequate health, medical, and accident insurance coverage for my child. I strongly recommend that my family carry personal liability and medical insurance.
9. PROPERTY: The Released Parties are not responsible for any personal property that is lost, stolen, or damaged during sessions.
10. PHOTO/VIDEO RELEASE (OPTIONAL): Unless I opt out by unchecking the photo release box, I grant the Released Parties permission to use photographs and videos of my child taken during Baba B-Ball sessions for promotional purposes, including social media and the Baba B-Ball website. I understand this is optional.
11. DISPUTE RESOLUTION: In the event of any dispute arising from this agreement or my child's participation, I agree to first attempt resolution through direct communication. If unresolved, I agree to pursue mediation before initiating any legal action. Any legal action must be brought in Cook County, Illinois.
12. GOVERNING LAW: This agreement shall be governed by the laws of the State of Illinois.
13. SEVERABILITY: If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
14. ENTIRE AGREEMENT: This waiver constitutes the entire agreement between the parties regarding liability for participation in Baba B-Ball sessions and supersedes any prior oral or written agreements.
15. BINDING EFFECT: This agreement is binding upon myself, my child, my heirs, executors, administrators, personal representatives, and assigns.
I HAVE READ THIS WAIVER IN ITS ENTIRETY. I UNDERSTAND THAT BY SIGNING, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY, WITHOUT INDUCEMENT.
This waiver is valid for one (1) year from the date of signing and covers all Baba B-Ball sessions attended during that period.
